You could think: if AI video adds details that aren’t there, isn’t that a misrepresentation?
In our AI videos, the virtual “camera” always “moves” within the original photo. Since it never “goes” outside the frame, the AI doesn’t “invent” entire parts of a room.
It only adds a slight parallax effect — where closer subjects move faster than distant ones — creating a natural sense of movement. When the “camera” pushes in, pulls out, or slides to the side, the AI simply crops the photo and adjusts proportions without adding much beyond what is already shown in the photo. Any details revealed by this effect are minor, and the AI predicts them with high accuracy.
In Ontario, using AI to add a parallax effect to still real estate photos is legal and does not constitute misrepresentation, provided the underlying image accurately reflects the property. Under the Trust in Real Estate Services Act (TRESA) — specifically the Code of Ethics — the primary legal threshold is whether an advertisement is “clear, accurate, and not misleading.” Since our AI videos stay within the existing frame and only predict minor details behind objects to create depth, they are a dynamic presentation of a factual photograph rather than a modification of physical attributes.
To remain fully compliant on the MLS and social media, the video must not obscure structural defects or present a version of the home that does not exist in reality. A video is acceptable as long as the AI-predicted fill is insignificant and the parallax effect does not create expectations that differ materially from what buyers would see in person (such as implying non-existent features, finishes, window views, or dimensions).
Even “minor” invented details can become a problem if they alter a buyer’s perception of the property or if the content is presented as a literal depiction rather than an effect. A simple disclosure noting that the video was created by AI aligns with the “avoid misleading” obligation emphasized by RECO and ensures you meet the high standard of honesty required by TRESA. All our videos include the following disclaimer to ensure you are covered when publishing on the MLS or social media:
“This video was created using AI-enhanced motion from still photography. For marketing and illustrative purposes only. Verify all features and measurements in person.”
Any AI that “corrects” flaws, removes permanent fixtures, or alters the size of a room during the motion could trigger a violation. You will never find such alterations in our videos.
